Case Summary : Decision-Making Process

A worker complained to the Commission that the WSIB and his LMR
service provider did not adhere to his medical restrictions, and
as a result he suffered further injury.
In reviewing the complaint, the Commission found that over the
past year the worker had been sent for two assessments at the WSIB
specialty hand clinic and one follow-up appointment. He had received
non-dominant hand training. His LMR hours were reduced several times
over the three and a half weeks he was in the training program to
accommodate his injury. He was provided with voice-activated computer
software. And, the assistant director wrote to him addressing all
of his concerns.
The Commission advised the worker that the WSIB’s actions
and responses were reasonable.
